1. Overview
At PromoVision Creative, we are committed to delivering high-quality marketing support services to agricultural businesses. We understand that circumstances may arise where a client needs to request a refund, and we have established this Refund Policy to provide clear, fair, and transparent guidelines for handling such requests.
This Refund Policy applies to all services offered by PromoVision Creative, including promotion strategy development, target audience analysis, market positioning research, marketing materials preparation, and general marketing coordination. Please read this policy carefully before engaging our services, as it forms part of the contractual agreement between you and our company.
2. Nature of Our Services
PromoVision Creative provides professional marketing support services that involve significant investment of time, expertise, intellectual resources, and specialized knowledge. Our services are customized for each client based on their specific business needs, product characteristics, market conditions, and promotional goals.
Because our services involve the creation of custom intellectual work, strategic analysis, research, and personalized deliverables, the refund terms differ based on the stage of service delivery at the time a refund is requested. We have structured our refund policy to be fair to both the client and our team, recognizing the unique nature of professional consulting and marketing support services.
3. Refund Eligibility
3.1 Full Refund Eligibility
A full refund may be issued under the following circumstances:
- The refund request is submitted within seven (7) calendar days of the initial payment date and no substantive work has commenced on the project. Initial consultations and preliminary discussions do not constitute commencement of substantive work.
- PromoVision Creative is unable to commence the agreed-upon services within thirty (30) calendar days of the scheduled start date due to reasons solely attributable to our company (not caused by client delays in providing required information or approvals).
- A significant technical or administrative error on our part resulted in incorrect billing, duplicate charges, or charges for services that were never ordered or agreed upon by the client.
3.2 Partial Refund Eligibility
A partial refund may be issued under the following circumstances:
- The refund request is submitted after work has commenced but before the project has reached fifty percent (50%) completion. In such cases, the refund amount will be calculated based on the percentage of work not yet completed, minus a reasonable fee for administrative costs and time already invested.
- PromoVision Creative materially fails to deliver agreed-upon services or deliverables as specified in the service agreement, and the deficiency is not corrected within a reasonable cure period of fifteen (15) business days after written notification from the client.
- Both parties mutually agree to terminate the service engagement before its completion, in which case the refund amount will be determined through good-faith negotiation based on the work completed and resources expended.
3.3 Non-Refundable Situations
Refunds will generally not be issued in the following circumstances:
- The project has been completed and all agreed-upon deliverables have been provided to the client, regardless of the client's subjective satisfaction with the outcomes, provided the deliverables meet the specifications outlined in the service agreement.
- The project has progressed beyond fifty percent (50%) completion based on the milestones and deliverables outlined in the service agreement.
- The client fails to provide necessary information, feedback, approvals, or cooperation required for the successful execution of the project, resulting in project delays or inability to proceed.
- The refund request is based on dissatisfaction with business outcomes that are beyond PromoVision Creative's control, such as market reception, customer response, sales performance, or external market conditions.
- The client changes their business direction, strategy, or requirements after work has substantially commenced, rendering previously completed work no longer relevant to their needs.
- Rush fees, expedite charges, or premium service surcharges that were incurred due to client-requested accelerated timelines.
4. Refund Request Process
To request a refund, clients must follow the procedure outlined below:
4.1 Submission
All refund requests must be submitted in writing via email to support@promovisioncreative.com. The request must include your full name, company name, the date of the original transaction, the service engagement or invoice number, a detailed explanation of the reason for the refund request, and any supporting documentation that may be relevant to your request.
4.2 Acknowledgment
Upon receipt of your refund request, PromoVision Creative will send an acknowledgment within three (3) business days confirming that we have received your request and that it is being reviewed. The acknowledgment will include an estimated timeline for our review and response.
4.3 Review and Evaluation
Our team will thoroughly review your refund request, considering the terms of your service agreement, the stage of project completion, the nature and quality of work delivered, and any other relevant circumstances. This review process typically takes between five (5) and ten (10) business days, depending on the complexity of the engagement.
4.4 Decision and Communication
Following our review, we will communicate our decision to you in writing, including the rationale for our decision and, if applicable, the refund amount and timeline for processing. If the refund request is denied, we will provide a clear explanation of the reasons and, where possible, suggest alternative resolutions such as additional revisions, scope adjustments, or service credits.
4.5 Processing
Approved refunds will be processed within fifteen (15) business days of the decision date. Refunds will be issued using the same payment method used for the original transaction unless otherwise agreed upon in writing. Please note that processing times may vary depending on your financial institution.
5. Service Credits
In certain situations where a monetary refund is not applicable or where both parties agree, PromoVision Creative may offer service credits as an alternative to a cash refund. Service credits represent a monetary value that can be applied toward future services with PromoVision Creative.
- Service credits are valid for a period of twelve (12) months from the date of issuance.
- Service credits are non-transferable and cannot be redeemed for cash or applied to third-party services.
- Service credits may be applied to any of PromoVision Creative's services, subject to availability and current pricing.
- Unused service credits that expire after the twelve-month validity period cannot be renewed or reinstated.
6. Revisions and Corrections
Before requesting a refund based on dissatisfaction with deliverables, we strongly encourage clients to take advantage of our revision process. Each service engagement includes a reasonable number of revisions as specified in the service agreement. Our revision process is designed to ensure that deliverables fully meet your expectations and requirements.
We believe that most quality-related concerns can be effectively addressed through our collaborative revision process, and we are committed to working with you to achieve results that meet or exceed your expectations within the agreed-upon scope of work.
7. Dispute Resolution
If you disagree with our refund decision, we encourage you to first contact us directly to discuss your concerns. Many disputes can be resolved through open communication and mutual understanding. If direct communication does not lead to a satisfactory resolution, the dispute will be handled in accordance with the Dispute Resolution provisions outlined in our Terms of Service.
8. Special Circumstances
PromoVision Creative recognizes that exceptional circumstances may arise that are not specifically addressed by this Refund Policy. In such cases, we will evaluate refund requests on a case-by-case basis, taking into account the specific circumstances, the relationship with the client, and principles of fairness and reasonableness. Our goal is always to find a resolution that is fair to both parties.
Examples of special circumstances that may be considered include but are not limited to serious illness or family emergency affecting the client's ability to proceed with the project, natural disasters or other force majeure events, significant changes in market conditions that fundamentally alter the basis of the engagement, and documented financial hardship.
9. Cancellation and Rescheduling
Clients who wish to cancel scheduled services before work has commenced should notify PromoVision Creative as soon as possible. Cancellations made at least fourteen (14) business days before the scheduled start date will receive a full refund. Cancellations made between seven (7) and thirteen (13) business days before the scheduled start date will be subject to a cancellation fee of twenty-five percent (25%) of the total engagement value. Cancellations made less than seven (7) business days before the scheduled start date will be subject to a cancellation fee of fifty percent (50%) of the total engagement value.
Rescheduling requests are subject to availability and may be accommodated without penalty if made at least seven (7) business days before the scheduled start date. Multiple rescheduling requests may be subject to administrative fees.
10. Amendments to This Policy
PromoVision Creative reserves the right to modify, update, or replace this Refund Policy at any time. Changes will be effective immediately upon posting the updated policy on our website. The refund terms applicable to your engagement will be those in effect at the time your service agreement was executed, unless otherwise agreed upon in writing.
